These Terms of Service govern your access to and use of the OpenBanqing platform, APIs, SDKs, documentation, and related services (the "Services"), provided by Open Finance Infrastructure Ltd..
By accessing or using the OpenBanqing Services, you agree to be bound by these Terms. If you are entering into these Terms on behalf of an organisation, you represent that you have authority to bind that organisation.
OpenBanqing provides open-banking infrastructure including PSD2/PSD3 account information and payment initiation, FDX-compliant data aggregation, FAPI 2.0–authenticated APIs, core-banking connectors, real-time payment routing, and regulatory reporting. The Services are provided under the tier selected in your subscription. We may modify, add, or remove features at our discretion, with reasonable notice for material changes.
You are responsible for safeguarding your API keys, credentials, and access tokens. You must promptly notify us of any unauthorised access. We support Strong Customer Authentication (SCA) under PSD2, and you agree to use SCA where required by applicable law.
You may not use the OpenBanqing Services to: (a) violate any law or regulation; (b) infringe intellectual property rights; (c) transmit malware or attempt unauthorised access; (d) circumvent rate limits, security measures, or compliance controls; (e) resell the Services without a written reseller agreement.
We process personal data in accordance with our Privacy Policy and Data Processing Agreement, and in compliance with GDPR, PSD2, ISO 27001, SOC 2 Type II, and applicable local regulations (e.g. UK FCA, EBA, NCB requirements).
Fees are governed by your subscription plan and any usage-based metering. Late payments may incur interest at the lower of 1.5% per month or the maximum permitted by law. We may suspend the Services for non-payment after 14 days' notice.
To the maximum extent permitted by law, Open Finance Infrastructure Ltd.'s aggregate liability under these Terms is limited to the fees paid by you for the Services in the twelve months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
Either party may terminate for material breach with 30 days' written notice (or immediately for breach of confidentiality, security, or acceptable-use). Upon termination, your right to access the Services ends; we will provide a 30-day data export window.
These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the English courts, except where mandatory consumer-protection law provides otherwise.
